1. Use of and Changes to the Current General Terms and Conditions
All use of the current website and services offered by website Free Horoscope http://www.mon-horoscope-du-jour.com implies the acceptance of the following general conditions. In the event that the user does not wish to accept all of or a part of the current general conditions, he or she is advised to refrain from all use of the service.
Free Horoscope reserves the right to make changes or modify all or part of the services and can at any time modify the terms of the General Conditions. In any event, the version of the General Conditions which apply to the user is the one that he or she has most recently accepted.
2. The User
All users who log on to the site must be persons aged 18 years or over.
The right to use these services is specific to each user. Certain services can be subject to compliance with specific conditions.
The user undertakes not to sell or use the contents and services for commercial purposes without prior agreement in writing from Free Horoscope.
The user is responsible for all use of his/ her account, whether or not expressly authorised by him/her.
The user recognises and accepts sole responsibility for the content of any data entered on the website. He/she accepts in particular that this data should not be of a nature that could prejudice the interests of Free Horoscope and/or the rights of third parties. To this effect, he/she indemnifies Free Horoscope against all claims, based directly or indirectly on this information and/or data, that may be brought by any person against Free Horoscope.
He/she undertakes in particular to meet the payment of all costs, whatever they may be, resulting from claims by a third party against Free Horoscope, including lawyers' fees and legal costs.
The user also undertakes to inform Free Horoscope of any infringement of which he/she may be aware; not to access or try to access illegally other computerised networks or systems linked to the website; not to interfere in the use or enjoyment of the services by other users; not to use the website to deliver viruses, Trojan horses or other harmful programs.
3. 3. Service Access
The service is accessible free of charge to all users with access to the internet. All costs relating to service access, whether for equipment, software or internet access, are solely at the expense of the user. He/she is solely responsible for the smooth operation of his/her computer equipment and internet access. Free Horoscope reserves the right to interrupt, temporarily suspend or modify without prior notice access to all or part of the service, in order to provide maintenance, or for any other reason, without incurring obligation or compensation.
Free Horoscope reserves the right to close the account of any user immediately and permanently refuse access to services to any user who supplies false information on registration , or if the user has violated the current General Conditions.
Mon Horoscope also has the right to close down a user's account if it is inactive for a period of 9 months or more.
5. Personal Data
Out of respect for the privacy of its users, Free Horoscope undertakes that the collection and processing of personal information on the current website is carried out in accordance with Law No. 78-17 of 6 January 1978 on Computing. In the event of a complaint or failure to deliver, the user should contact Free Horoscope at the address on the website. Free Horoscope also emphasises the essentially recreational nature of the services. In no way does the website's content constitute legal, psychological, medical, professional or financial advice. Similarly, studies carried out by the website cannot be a substitute for a medical or psychological diagnosis carried out by a health professional.
7. Limitation of Liability
Some advertising banners on the Free Horoscope website lead the user to follow links to other websites. In so far as no control is exercised over these external resources, the user should recognise that Free Horoscope accepts no responsibility for the provision of these resources and cannot be held responsible for their content; the data that you enter on these websites is no longer protected by Free Horoscope.
8. Property Rights
The user recognises and accepts that the content (written documents, software, photographs, logos…) of advertising material sponsored or distributed by email, commercial information produced and entered by Free
Horoscope, its suppliers and advertisers, is protected by French intellectual property rights, trademark law, patent law or any other law recognised by existing legislation.
The user does not have authorisation to copy, use, reproduce, distribute or create works derived from the content, without obtaining the express agreement of Free Horoscope, its suppliers or advertisers.
Any unauthorised reproduction of these trademarks, logos and distinctive signs constitutes an infringement punishable by law. Offenders risk incurring civil and legal proceedings and specifically the penalties stipulated in Articles L.335.2 and L.343.1 of the Code de la Propriété Intellectuelle (French Code of Intellectual Property).
